Women’s Injustice


Women have fought for the right to their bodies for long enough. There has been a debate of whether women should be able to choose to get an abortion, or restrict the choice completely. The Texan government isn’t doing anything to help ensure women have these rights either. Instead, they have made it worse. Texan lawmakers have taken it upon themselves to take power over women and what they do with their bodies.

Texas passed a new law on May 19th, 2021. This bill is known as Texas Senate Bill 8, or the Heartbeat Bill. This bill restricts women from getting abortions as soon as a fetal heartbeat can be detected. A heartbeat can be detected from as early as 3-4 weeks, or more commonly 5-6 weeks.  One of the many issues is the ‘heartbeat’ being heard isn’t technically a heartbeat, but a flutter in the area that will eventually become the heart of the fetus. (https://www.livescience.com/65501-fetal-heartbeat-at-6-weeks-explained.html.) This bill also overlooks that most women don’t even know that they are pregnant until 4-7 weeks. (https://americanpregnancy.org/healthy-pregnancy/week-by-week/5-weeks-pregnant/). By the time a woman finds out that she’s pregnant, it’s too late. Too late for a terrified, unprepared woman to express her right to choose.  

The fight for women’s rights has gone on for longer than one would think. The debate of whether a woman should able to choose to get an abortion has been taken to the courts before. Texas used to have a statute in place banning abortion, but on January 22, 1973 Roe v. Wade took place in the U.S. Supreme Court. (https://www.history.com/topics/womens-rights/roe-v-wade). This Supreme Court case affirmed that access to legal and safe abortion is a constitutional right. So when federal judges saw Texas lawmakers wanted to go against Roe v. Wade, they weren’t on board with their attempt to ban abortion again.

The Department of Justice has taken the side of Texan women and made a change regarding SB 8.  The Department of Justice has just filed a lawsuit against Texas saying this bill is unconstitutional. Federal Judges say it goes against Roe v. Wade which is protecting a woman’s right to choose to have an abortion without government restriction. So far, all that is in place is a federal judge placing a block on the enforcement of this bill. This is a huge win for Texan women, as hey are slowly gaining back their rights to their bodies.
